KlepperThe law is clear on the ability to sue the owner of a pool for negligence if the owner(s) fail to secure the pool properly.  Most states and even cities have laws or ordinances that require a pool owner to have several things such as fences, gates and in some cases even special covers for the pool.  Failure of a pool owner to follow their city or state laws exposes them to Negligence Per Se violations of the law.
